Implementing Intellectual Property Provisions in New-Generation Free Trade Agreements in the EU

The inclusion of chapters that introduce a high standard intellectual property protection in free trade agreements has become an essential feature the international commercial policy developed countries. Based on analysis legal policies and practices entering into implementing commitments new generation European Union (EU), this article points out there are two prominent aspects provisions agreements. On one hand, comparison to partners being developing countries, EU always been position negotiating party with superior system; therefore, goal these is provide “sticks carrots” push countries change their laws, policies, standards. From perspective comparative law theory, implementation will lead “transplantation transformation” legislations from partner other some typical cases related i) genetic resources, traditional knowledge, ii) technology transfer, have also gained certain achievements including above issues agreements; thereby imposing obligations implement commitments.
